1 The word “guarantee” in the following, refers to the guarantee of passing the practical driving test the first time. Guarantee of passing the driving test is conditional on the following:
2 The practical driving test should not be booked until your instructor confirms you are ready for the test.
2.1 If the practical test is booked when your driving instructor recommends it should not be, but the pupil goes ahead and books it anyway, the guarantee will become invalid.
2.2 The guarantee is not valid for the extended driving test.
3 First lesson free only refers to when more lessons, or a course of lessons are booked. Free lesson will be given when pupil commits to lessons with the instructor.
3.1 If the practical driving test is booked without the prior knowledge of your instructor the guarantee will become invalid.
3.2 For the guarantee to be valid for an intensive course the course must be of at least 40 hours duration.
3.3 The instructor reserves the right to postpone the driving test on any course of driving lessons, including intensive courses, if the pupil has not reached the standard needed to pass the driving test. The instructor will always try to do this in time for the pupil to move their test date without losing their test fee, currently 3 working days.
3.4 A deposit of £100.00 for intensive courses is only refundable 7 days before the course commences.
3.5 If the pupil chooses not to complete the intensive course once it has started, for any reason, the amount refundable will be for the remaining hours after 7 days from the time it was cancelled. i.e if the course is over a 12 day period and the pupil cancels on day 3 then the refunded amount will be for the last 2 days.
4 During intensive courses, any missed lessons including the assessment lesson will render the guarantee invalid.
5 If the pupil is using their own vehicle for an intensive course, any mechanical failure or situation outside of the control of the instructor leading to a missed lesson or lessons or driving test, will render the guarantee invalid.
5.1 If the pupil is using their own vehicle for the practical driving test, any mechanical or other failure of the vehicle to start or complete the test will render the guarantee invalid.
5.2 If the test is unable to go ahead for any reason outside of the instructors control, such as fuel shortages, strikes by relevant authorities, lateness of the pupil, road blockages, emergency situations etc the guarantee will become invalid. However, in certain circumstances the DSA will give the pupil a new test date without charge.
6 Once the practical driving test has been booked, pupils must continue regular lessons on the advice of the instructor or the guarantee will become invalid.
6.1 If the pupil cancels a lesson at short notice, i.e less than 24 hours, the guarantee will become invalid.
6.2 If the pupil cancels a lesson with less than 24 hours notice the lesson will be charged at the normal hourly rate.
6.3 If a pupil wishes to cancel the remainder of lessons booked in a block of 10 hours, all used hours will be charged at the normal hourly rate, and an administration fee of £35.00 will be deducted from the remaining amount. The administration fee of £35.00 will be deducted seperately from each block of 10 hours if more than one block was booked, and an administration fee of £35.00 will also be decucted from a block booking of between 2 and 9 hours if cancelled. Example: If 13 hours are booked and the pupil wishes to cancel after 2 lessons, an administration fee of £70.00 will be deducted. £35.00 for the block of 10 hours and £35.00 for the remainder of the block of 3 hours.
6.4 If the pupil cancels a lesson and the instructor is unable to fit that lesson in elsewhere during that same week the guarantee will become invalid.
7 If the practical driving test does not go ahead due to failure of the eyesight test by the pupil the guarantee will become invalid.
8 If the pupil terminates the practical driving test at their own request either before or during the test, the guarantee will become invalid.
9 If the practical driving test does not take place due to any negligence on behalf of the pupil, including not having the correct documents, being at the wrong test center, having the wrong date or time, then the guarantee will become invalid.
10 If the car being used for the practical driving test is involved in an accident before or during the test, whether due to an error by the pupil or not, then the guarantee will become invalid.
11 If the pupil fails the practical driving test, in order to receive the free retest they must continue with the amount of lessons the instructor recommends before they book their second test. 10 hours of lessons is the minimum after a failed driving test.
12 If the pupil books their second test without prior knowledge of their instructor then the guarantee will become invalid.
13 If the pupil is unable to take the practical driving test due to illness or any other reason out of the instructors control the guarantee will become invalid.
14 If the pupil takes a driving test through another instructor, driving school or independently then the guarantee will become invalid.
15 Once the pupil begins driving lessons with the instructor, then the amount of lessons recommended by the driving instructor must be taken or the guarantee will become invalid.
16 If the pupil fails the second test then the instructor has met the conditions set out in this contract and absolutely does not give any more tests or lessons free of charge.
17 If the pupil fails the second test and they wish to continue using the services of the instructor, they must not book another driving test without prior knowledge of the driving instructor.
18 If any payment owed to the driving instructor is outstanding on the day of the driving test, unless received in full in cash prior to the start of the driving test, then the guarantee will become invalid.
19 If any uncleared payments by cheque or any other payment method for lessons or test fees are outstanding on the day of the test, unless received in full in cash prior to the start of the driving test, then the guarantee will become invalid.
20 If the pupil physically, mentally or verbally abuses the instructor, the instructors family, friends, colleagues, members of the public, person involved in the execution of their duties, ie. a police officer, other pupils or examiners then the instructor reserves the right to terminate any contract involving providing driving lessons and driving test without prior notice. The guarantee will also become invalid.
21 When redeeming a gift voucher, it is the voucher holders responsibility to contact the instructor to book lessons.
21.1 Any voucher holder missing a pre-booked lesson will not be refunded in time lost.
21,2 All vouchers are valid for 1 year from the occasion they were intended for i.e birthdays or Christmas.
21.3 No refund will be given on any unused hours left on the voucher at the end of the 1 year period.
22 If the pupil wilfully damages the instructors vehicle or any other property not owned by the pupil the guarantee will become invalid.
23 It is the pupils responsibility to have read all these terms and conditions and not that of the instructors. If the pupil does not understand any of these terms and conditions he/she must tell the instructor at the earliest opportunity. Not understanding the terms and conditions does not render the terms and conditions invalid even if the pupil informed the instructor. The instructor will do their best to help the pupil understand the terms and conditions that they are having difficulty understanding, but does not accept any liability for the pupil not understanding either the written or verbal terms and conditions.
24 If the pupil has any concerns about wrong doing by the instructor, he/she must inform the instructor at the first available opportunity verbally and by email. A copy of the email should be saved by the pupil so the time and date of the concern is documented.
25 If the pupil wishes to continue with the Pass Plus course with the instructor after passing the practical driving test no offers are connected to this course, and will cost the amount set out on the instructors website at that time.
26 If you, the pupil, cannot agree to these terms and conditions for what ever reason, then the guarantee will become invalid.
